A Trademark ™ is an intellectual property consisting of a legally recognizable word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, that identifies and distinguishes a source from those of others. The Trademark owner can be an individual, business organization, or any legal entity registered. The Trademark gives someone, Company or organization the authority or means to own the word, phrase, symbol, mark or, the design amongst other things, take legal action against anyone who uses the registered Trademark without permission and in essence it is an asset. It allows the owner to legally put the ® symbol next to the brand – to show ownership and warn others against using it. We register your Trademark based on Nigeria’s Trademark Classification.

Nigeria is a party to the Nice Agreement, and under this agreement, trademarks are classified under 45 classes. At QSL, we offer a Trademark that will be protected under the category which is most relevant to your business/service. You can also be protected under multiple classes.

After payment is made, received and acknowledged, we will require a scan of the logo, brand name/Trademark you intend to protect, and information about the line of business or type of service provided. After the application is successfully made and acknowledged, the Trademark Registry will issue an Acceptance Letter. The Acceptance Letter is evidence of acceptance and registration, and this is accepted by other organizations who request it to process other records, e.g. SON, NAFDAC, etc

Furthermore, there is a period during which members of the public can object to the registration. This is when the Trademark is published in the Trademark Journal, if a published Trademark is not opposed to within the specified time frame, the applicant will be able to apply for a Certificate. The grant of the Certificate is the final stage of the process.

QSL registers individuals who are interested in owning their business entities in Nigeria under Part B of the Companies and Allied Matters Act. This process is known as Business Name Registration. A registered business name is one of the three general company structures which an individual can register in Nigeria; the other two are incorporated companies and incorporated trustees.

Business Name Registration Process

Choose and reserve a name, and suggest two alternate names for the client’s business.

The CAC will conduct a search in its database to ensure that the name is not already in use or there is no similar name already in use.

If the CAC approves the name, then it will reserve the name for the client for 60 days. During this period, it is expected that the client will complete the registration process for the business name.

Complete the Business Name Registration Forms – As with Step 1 above, this can also be completed. The information required for the process includes:

  • Approved Name of the Business
  • General Nature of the Business
  • Address of the Business
  • Name, Address, Occupation and other details of the Proprietors of the Business
  • Signature of the Proprietors

Submission of Forms – the CAC will review the documentation, and if all is in order, the CAC will then notify the registrant that the application has been approved and the Business Name Certificate is ready for collection. The entire process time should ideally take about one week, although it depends on the workload of the CAC at the time.

CHANGE OF NAME SERVICE

The change of name service covers the entire process from drafting the relevant documents, stamping in Court, publication in a national newspaper, and courier delivery within the FCT. Clients outside of Abuja are liable to pay the courier costs based on their location. The entire process takes 5-7 working days.
